New Case Alleges Groundwater Contamination in Anne Arundel County

Murphy, Falcon & Murphy has recently filed suit on behalf of a property owner against Constellation Energy, alleging $20 million in damages caused by the energy company’s nearby dump site for waste products created by burning coal.

Attorney Gregory K. Kirby is spearheading the firm’s efforts. According to the suit, the groundwater, which a golf course uses, has been polluted by contaminants of the so-called fly ash. The golf club, which relies on healthy soil and grass, has suffered environmental harm from the contaminated groundwater.

Fly ash, a byproduct of burning coal, is a known environmental pollutant. Comprised of metals like aluminum, arsenic and lead, along with other dangerous contaminants, it can cause severe neurological disorders and cancer when ingested or inhaled for a long period of time, although that is not the crux of this case. The environment, however, doesn’t fare much better.

This is not the first case of its kind to be brought by Murphy, Falcon & Murphy. In 2008, a $54 million settlement was reached on behalf of Maryland homeowners whose drinking wells had been contaminated by fly ash (also against Constellation Energy).
